Briefings for activists and paid officials on the DCLG's proposals for the 'new llok' LGPS will have taken place in every Region outside Scotland by the end of this week. Every where there has been stimulating discussion and questions asked about the proposals and UNISON's response to them.
However, there is still some confusion over the proposals themsevles and what we are saying about them. In particular, questions have been asked about: - Protection

Protection - Still fighting! While there have been improvements to the ODPM's original proposals on protection, we are still fighting hard on the protection front. The Amendment Regulations are now law, but can be amended at any time. As things stand, existing LGPS members will: - Continue to be covered by the 85 year rule until 31st March 2008 - not 2006 as orginally proposed.
- Be protected until 2016 - rather than 2013 - if they are 60 by March 2016.
- Have any early retirement reduction phased in if they are 60 between 1st April 2016 and 31st March 2020.
The Judicial Review UNISON's challenge to the Amendment Regukations through a judicial review will be heard in the High Court on 18th and 19th September. We are challenging the Government's view that the 85 year rule and full protection are age discriminatory. We are also claiming that the consultation on the Regulations was based on incorrect financial information. UNISON's actuarial advisors, AON, will give evidence, alongside senior officals involved in the negotiations. Whatever the outcome of the Judicial Review, we will continue our fight for full protection with a new ballot for industrial action if the Government and the LGA don't see sense. |
